Terms of Service

These Terms of Service ("Terms") govern your use of the One Of You Is Wrong iOS app (the “Service”), operated by Escape Velocity Ventures (Escape Velocity Partners LLC DBA Escape Velocity Ventures) (“we,” “us,” “our”). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement. Users under 18 must have parental or guardian consent.

2. Subscriptions and Payments

The Service offers a free trial and paid subscription tiers. All payments are processed by Apple through the App Store. Subscription terms, pricing, and cancellation policies are governed by Apple's App Store Terms of Service.

• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
• You can manage or cancel your subscription in your Apple ID settings.
• Refunds are handled by Apple in accordance with their refund policies.

3. Acceptable Use

You agree not to use the Service to:

• Record or submit content that is illegal, harmful, harassing, or abusive.
• Record any person without their knowledge and consent where such recording would violate applicable wiretapping or eavesdropping laws.
• Attempt to circumvent usage limits or authentication mechanisms.
• Interfere with or disrupt our servers or the Service.
• Use automated tools, bots, or scripts to interact with the Service.
• Submit content that violates any applicable law or the rights of any third party.

You represent and warrant that you have obtained all necessary consents from all participants before recording any debate. You are solely responsible for compliance with applicable recording consent laws in your jurisdiction.

4. Content

You retain ownership of any audio recordings you submit. By submitting content, you grant us a limited, temporary license to process it solely for the purpose of generating your verdict. We do not claim ownership of your content. Submitted audio is deleted from our servers once your verdict is delivered, and in all cases no later than 24 hours after submission.

5. AI-Generated Content Disclaimer

IMPORTANT: All verdicts, scores, analysis, and commentary generated by this Service are produced by artificial intelligence (AI) and are provided solely for entertainment and amusement purposes. AI verdicts:

• Are NOT legal, medical, financial, or professional advice
• May contain errors, biases, or inaccuracies
• Should NOT be relied upon for any consequential decision
• Do not represent the views of Escape Velocity Ventures

Fact-check results (available to More, Max, and trial subscribers), including claim verdicts labeled TRUE, FALSE, MISLEADING, or UNVERIFIABLE, are generated by third-party AI services using automated web searches. They may contain errors, outdated information, or incorrect source attributions. Fact-check results are provided for entertainment and informational purposes only and should not be relied upon as authoritative.

You assume all risk associated with reliance on AI-generated content.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI verdicts will be accurate, unbiased, or appropriate for any particular purpose.

7. Limitation of Liability

To the maximum extent permitted by law, Escape Velocity Ventures shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

8. Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms. You may stop using the Service at any time by deleting your account in the app.

9. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.

10. Indemnification

You agree to indemnify, defend, and hold harmless Escape Velocity Ventures, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) your use of the Service, (b) your audio submissions, (c) recording other participants without proper consent, (d) your violation of these Terms, or (e) your violation of any third-party rights.

11. Dispute Resolution

Any dispute arising from these Terms or the Service shall be resolved by binding arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules, except that either party may seek relief in small claims court for claims within its jurisdiction. Arbitration shall be conducted in Wake County, North Carolina, before a single arbitrator.

CLASS ACTION WAIVER: You agree to resolve disputes individually and waive the right to participate in class actions, class arbitrations, or representative actions.

OPT-OUT: You may opt out of this arbitration provision by sending written notice to legal@escapevelo.com within 30 days of first using the Service.

12. Apple App Store Terms

Your use of paid features is also governed by Apple's App Store Terms of Service, which control billing, refunds, and payment processing.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Escape Velocity Ventures regarding the Service and supersede all prior agreements and understandings.

16. Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms to a successor entity in a merger, acquisition, or asset sale without notice.

17. Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, acts of war, pandemics, internet outages, or government actions.

18. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision.
